Terms of Use

These Terms of Use ("Terms") are a legally binding agreement between you and ATOMFLOW governing websites, apps, software, digital tools, content, features, and related services that link to or reference these Terms (collectively, the "Service").

By downloading, installing, accessing, creating an account, using guest mode where available, purchasing a subscription, or otherwise using the Service, you agree to these Terms.

1. Scope and product-specific notices

These Terms apply across ATOMFLOW products unless a particular Service is accompanied by a product-specific privacy policy, subscription notice, community rule, or other supplemental notice. If there is a conflict, the product-specific notice controls for that Service.

2. Eligibility

You must be at least 13 years old, or the minimum age required by law in your jurisdiction, to use the Service. If you are under the age of majority where you live, you may use the Service only with the consent and supervision of a parent or legal guardian.

3. The Service

ATOMFLOW may offer one or more consumer or business apps and digital services. Depending on the product, the Service may allow you to upload content, organize information, create or save content, access paid features, receive recommendations, manage reminders, use guest access, or interact with features we make available.

Unless expressly stated otherwise, the Service is provided for informational, organizational, convenience, or internal business purposes only and does not provide professional medical, legal, financial, valuation, therapeutic, or regulatory advice. Suggestions, automated outputs, reminders, rankings, tagging, and recommendations may be inaccurate, incomplete, delayed, or unsuitable for your circumstances.

We may modify, improve, suspend, restrict, or discontinue all or any part of the Service at any time, to the maximum extent permitted by law.

4. Accounts, guest access, and security

Certain features may require an account. Some features may be available in guest mode.

If you use guest mode, you acknowledge that syncing, backups, purchase restoration, account recovery, portability, or saved data may be limited or unavailable. To the maximum extent permitted by law, we are not responsible for loss of guest data resulting from app deletion, logout, device changes, platform restrictions, or failure to link guest usage to a registered account.

If you create an account, you must provide accurate information, keep your credentials secure, and are responsible for activity under your account. Notify us promptly at enquiry@atomflowstudio.com if you suspect unauthorized access.

We may monitor, investigate, restrict, rate-limit, suspend, block, or terminate accounts, guest access, usernames, features, or access to all or part of the Service where reasonably necessary to protect the Service, comply with law, resolve disputes, recover unpaid amounts, or prevent fraud, abuse, impersonation, misuse, excessive use, abnormal activity, or suspected spam.

5. License

Subject to your compliance with these Terms, we grant you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to access and use the Service for your personal or internal business use, as applicable.

You may not, except as allowed by law:

  • copy, sell, lease, sublicense, or commercially exploit the Service;
  • reverse engineer or attempt to derive source code;
  • bypass security or access controls;
  • use the Service to build or support a competing product;
  • scrape, crawl, spider, or use automated means to access the Service; or
  • interfere with the integrity, performance, or security of the Service.

6. User content

"User Content" means content you upload, submit, store, generate, or otherwise make available through the Service, including images, videos, documents, text, comments, preferences, notes, tags, lists, profile information, and metadata.

You retain ownership of your User Content. You grant us a worldwide, non-exclusive, royalty-free, sublicensable, transferable license to host, store, cache, copy, reproduce, modify, adapt, process, transmit, display, publish, distribute, and otherwise use your User Content solely to operate, maintain, secure, back up, improve, personalize, and provide the Service; prevent fraud or misuse; comply with legal obligations; enforce these Terms; and create aggregated or de-identified analytics.

If a Service later enables sharing, collaboration, or public posting, content you choose to share may become visible to others and may be copied or re-shared by recipients.

You represent that you have the rights needed to upload your User Content and that it does not violate law or third-party rights.

We may review, remove, disable, preserve, or disclose User Content where reasonably necessary to operate the Service, enforce these Terms, investigate misuse, protect rights or safety, or comply with law.

7. Prohibited conduct

You may not use the Service to:

  • violate law or third-party rights;
  • upload unlawful, infringing, abusive, hateful, deceptive, or harmful content;
  • upload malware or harmful code;
  • probe or test vulnerabilities;
  • harvest personal data of others;
  • impersonate a person or entity;
  • abuse subscription, refund, ad, or promotional systems;
  • spam, flood, excessively or repeatedly use, or otherwise abuse any feature, form, endpoint, workflow, or part of the Service in a manner that is abnormal, automated, disruptive, or likely to impair the Service or other users' experience;
  • circumvent rate limits, access controls, or other technical or usage restrictions; or
  • damage, overload, or impair the Service.

Without limiting any other rights or remedies, we may take any technical, administrative, contractual, or legal action we consider appropriate in response to misuse of the Service, including preserving relevant records, refusing service, removing content, reporting conduct to relevant authorities, and seeking injunctive relief, damages, costs, and any other available remedies to the maximum extent permitted by law.

8. Paid features and subscriptions

Certain features may require a paid subscription or one-time in-app purchase.

At this time, paid purchases for ATOMFLOW mobile apps are offered only through the applicable app marketplace, such as Apple App Store or Google Play, unless we expressly state otherwise for a particular Service.

If you purchase a paid feature or subscription:

  • pricing, billing frequency, free trial terms, introductory pricing, renewal terms, and other purchase conditions will be shown in the relevant marketplace or purchase flow before purchase;
  • unless otherwise stated, subscriptions renew automatically until canceled in accordance with the rules of the platform through which you purchased;
  • billing, payment processing, renewals, cancellations, credits, and refunds are handled by the platform through which you made the purchase and are subject to that platform's rules and applicable law;
  • for App Store or Google Play in-app purchases, we do not directly process or store your full payment card information unless we expressly state otherwise; and
  • we may change prices as permitted by law and platform rules.

If applicable law requires additional disclosures at checkout or prior to purchase, the relevant marketplace purchase flow and any required product-specific disclosures form part of these Terms.

9. Third-party services

The Service may rely on or include third-party infrastructure, analytics, crash reporting, authentication, storage, billing, subscription management, advertising, attribution, AI, and monetization services. We are not responsible for third-party services, content, products, availability, pricing, privacy practices, or acts or omissions. Your dealings with third parties are between you and the third party.

10. Data deletion and backup limits

You acknowledge that deleted content, guest data, account data, uploaded files, cached files, backups, logs, derived data, and other information may not be recoverable in all circumstances.

We may maintain backups, redundancy, recovery tools, or business continuity measures for our own operational purposes, but those measures are not a dedicated preservation or restoration service for you and may be incomplete, delayed, overwritten, corrupted, or unable to restore a specific item of data.

To the maximum extent permitted by law, we are not responsible for loss, corruption, unavailability, or failed restoration of data resulting from account deletion, guest mode limitations, user actions, software defects, sync issues, cyberattacks, unauthorized access, infrastructure failures, third-party failures, app store or device restrictions, force majeure events, or other causes beyond our reasonable control.

We may use commercially reasonable efforts to investigate incidents and, where feasible, restore data from available backups or other sources, but we do not guarantee any recovery result, restoration outcome, or response timeline.

11. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED ON AN "AS IS," "AS AVAILABLE," AND "WITH ALL FAULTS" BASIS.

WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF HARMFUL COMPONENTS, OR THAT ANY DATA, CONTENT, OUTPUTS, OR SUBSCRIPTIONS WILL BE ACCURATE, COMPLETE, AVAILABLE, OR PRESERVED WITHOUT LOSS.

While we may use commercially reasonable efforts to maintain the security, integrity, and availability of the Service and respond to incidents, we do not guarantee uninterrupted access, successful recovery, or that loss, corruption, unauthorized access, unauthorized disclosure, or unavailability of data will never occur.

YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK.

12. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ATOMFLOW AND ITS AFFILIATES, LICENSORS, SERVICE PROVIDERS, AND PERSONNEL WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, BUSINESS, GOODWILL, USE, DATA, OR SAVINGS, ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS WILL NOT EXCEED THE GREATER OF:

  • the total amount you paid us for the relevant Service in the 12 months before the event giving rise to the claim; or
  • USD $100.

Nothing in these Terms excludes liability that cannot be excluded under applicable law.

13. Indemnity

To the maximum extent permitted by law, you agree to indemnify and hold harmless ATOMFLOW and its affiliates, personnel, licensors, and service providers from claims, losses, liabilities, and expenses arising from your User Content, misuse of the Service, or violation of these Terms or applicable law.

14. Changes

We may update the Service and these Terms from time to time. If there is a material change, we may provide notice by in-app notice, email, or other reasonable means. Continued use after the effective date means you accept the updated Terms to the maximum extent permitted by law.
